1. Definitions
In these Terms and Conditions, the following definitions apply:
1.1. “Company” means Boiler and Plumbing Ltd, a company registered in the United Kingdom, with its registered address at Office 1, 15 Grafton Road, Worthing, West Sussex, BN11 1QT.
1.2. “Customer” means the individual or organisation engaging the Company to provide the Services.
1.3. “Services” means any boiler, plumbing, heating, or related work undertaken by the Company for the Customer, as detailed in a valid quote or contract.
1.4. “Agreement” means the contract between the Company and the Customer for the provision of Services, which is governed by these Terms and Conditions.
1.5. “Contract” means the date on which the Customer accepts a written quote from the Company or otherwise agrees to engage the Company’s Services.
1.6. “Service” means any ongoing maintenance or service plan offered by the Company, the specific details of which are set out in Clause 4 below.
2. Services Provided
2.1 The Company offers services including, but not limited to:
- Boiler installation, repair, and maintenance.
- Central heating system servicing.
- Plumbing installations and repairs.
- Emergency plumbing and heating callouts.
2.2 The full scope of the specific Services to be provided will be detailed in a written quote or contract provided to the Customer before any work commences.
3. Service Plans Overview
The Company offers the following Service Plans. The details below outline what is and is not included in each plan.
3.1. Boiler Plumbing Pipes Service Plan
3.1.1. Overview: This plan ensures that your central heating system remains functional and efficient by covering essential maintenance and repair work for the pipes that connect to and support your boiler system.
3.1.2. What’s Included:

Annual inspection of boiler plumbing pipes.

Leak detection and repair for connected pipes.

Maintenance of pipe connections to ensure optimal water and heat flow.

Support for issues arising from wear and tear of the pipes.

Emergency call-outs for pipe-related faults impacting the boiler.

3.1.3. What is NOT Provided Under the Plan:

Replacement of plumbing pipes beyond a certain length (e.g., major overhauls or full system replacements).

Any pipework not directly connected to the boiler system.

Repair of pipes damaged due to third-party interference or external factors.

3.2. Gas Supplier Service Plan
3.2.1. Overview: This plan supports the safe and efficient management of the gas supply to your home or business, focusing on your property’s internal gas systems. It excludes responsibilities related to your chosen gas supplier.
3.2.2. What’s Included:

Inspection and maintenance of gas lines connected to your appliances.

Gas leak detection and repair.

Emergency response for gas supply disruptions within the property’s internal gas network.

Annual safety checks for compliance with UK regulations.

3.2.3. What is NOT Provided Under the Plan:

Dealing with billing or account issues with your gas supplier.

Repairs or maintenance on supply pipes outside your property boundary.
-
Resolving supply interruptions caused by your gas provider.
4. General Terms (“the Services”):
4.1 By engaging the Company’s Services, the Customer agrees to be bound by these Terms and Conditions.
4.2 The Company reserves the right to modify these Terms and Conditions at any time. Updated terms will be published on the Company’s website and apply to future agreements.
4.3 All Agreements are subject to the availability of materials and the Company’s workforce. The Company will notify the Customer as soon as reasonably possible if any delays are anticipated.
5. Quotations and Pricing
5.1. Quotations are valid for 30 days from the date of issue unless stated otherwise in writing.
5.2. Prices are inclusive of VAT unless explicitly stated otherwise.
5.3. Additional charges may apply for unforeseen work or changes requested by the Customer after work has commenced. Any additional costs will be communicated to the Customer and agreed upon in writing before the additional work is carried out.
6. Missed Appointments
6.1. We reserve the right to charge you £120.00 to cover our call-out costs if a scheduled appointment has been confirmed in writing but is missed by you, or if you cancel the appointment with less than 24 hours’ notice.
7. Transferring your plan:
7.1. Your Service Plan cannot be transferred to any other person, property, or equipment.
8. Payment Terms
8.1. A deposit may be required before the commencement of Services. The deposit amount will be confirmed in writing at the time of quotation.
8.2. Final payment is due upon completion of the agreed work unless otherwise stated in the contract. The Company accepts payment by e.g., bank transfer, credit/debit card, cash.
8.3. The Company reserves the right to charge interest on overdue payments at a rate of 4% per annum above the Bank of England’s base rate, calculated on a daily basis until payment is received in full.
9. Customer Responsibilities
9.1. The Customer must provide safe and clear access to the premises and the relevant equipment at the agreed times.
9.2. The Customer must ensure all necessary consents (e.g., from a landlord, planning department, or building control) are in place before work commences.
9.3. The Customer must inform the Company of any hazards or specific requirements at the premises that could affect the safe delivery of Services (e.g., asbestos, pets, confined spaces).
10. Warranties and Guarantees
10.1. The Company guarantees its workmanship for 12 months from the date of completion of the Services. This guarantee covers the repair or remediation of faults arising solely from defective workmanship.
10.2. Manufacturer warranties apply to any parts or appliances installed. The Company will reasonably facilitate warranty claims but is not responsible for, and accepts no liability for, defects in materials or manufacturer faults.
10.3. This guarantee does not cover damage or faults caused by misuse, neglect, accident, failure to follow instructions, or third-party interference after the work is completed.
11. Liability
11.1. Nothing in these Terms and Conditions shall limit the Company’s liability for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any other matter for which it would be illegal to limit or exclude liability.
11.2. Subject to clause 10.1, the Company’s total liability to the Customer for any loss or damage arising out of or in connection with the Services, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the total price paid for the Services under the relevant Agreement.
11.3. The Company shall not be liable to the Customer for any indirect or consequential loss, including but not limited to loss of profit, loss of business, or damage to property not caused directly by the Company’s negligence.
11.4. The Company will not be held liable for delays or failure to perform its obligations caused by circumstances beyond its reasonable control (“Force Majeure”), such as adverse weather, supply chain issues, acts of God, or utility failures.
12. Cancellation and Refunds
12.1 For one-off repair or installation services, customers may cancel by providing written notice info@boilerandplumbing.com at least 48 hours before the scheduled commencement time.
12.2 For cancellations of one-off services made less than 48 hours before the scheduled start time, the Company may charge a cancellation fee to cover reasonable costs already incurred, including but not limited to administrative costs, staff time, and the cost of materials ordered specifically for the job.
12.3 Deposits are generally non-refundable for one-off services. However, this does not affect your statutory rights. If you have purchased a Service Plan under a distance contract (e.g., online or by phone), your right to cancel is governed by our Refund & Cancellation Policy and the 14-day statutory cancellation period, which overrides this clause.
12.4. For all Services, if the Company cancels the agreed work for reasons other than the Customer’s breach of these terms, any deposits or advance payments will be fully refunded.
13. Health and Safety
13.1 The Company complies with all relevant health and safety regulations.
13.2 The Customer must take reasonable steps to ensure the work area is safe and free from hazards for the Company’s operatives and must point out any known risks in advance.
14. Complaints and Disputes
14.1 Any complaints about the Services must be submitted in writing to the Company at info@boilerandplumbing.com within 14 days of the issue arising.
14.2 The Company will investigate and respond to complaints in writing within 7 working days of receipt.
14.3 If disputes cannot be resolved amicably through the Company’s complaint procedure, both parties agree to attempt to resolve the dispute through mediation before initiating legal proceedings. If mediation fails, the dispute will be resolved in the courts of England and Wales.
15. Governing Law
15.1 This Agreement is governed by the laws of England and Wales.
15.2 Any legal proceedings arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15.3 These Terms and Conditions do not affect your statutory rights as a consumer.
16. Data Protection
16.1 The Company complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

17. Entire Agreement
17.1 These Terms and Conditions, together with any written quote or contract provided by the Company, constitute the entire agreement between the Company and the Customer in relation to the provision of Services.
17.2 Any amendments or variations to this Agreement must be agreed upon in writing and signed by both parties.
